Tom Jones


Year of call: 2013

Tom joined chambers on completion of pupillage in September 2014. He has quickly developed a broad and busy practice encompassing all aspects of Intellectual property. Since taking tenancy Tom has been and continues to be involved in matters before the UKIPO, IPEC, High Court and Court of Appeal.

Tom has experience covering the breadth of intellectual property law including patents, trade marks, passing off, design right, copyright and confidential information.Tom is currently instructed in the Unwired Planet series of patent litigation before the High Court concerning standard essential mobile telecoms patents. He has attended two full trials and is working on a further trial concerning FRAND issues. During pupillage he worked on the trials of  AGA v Occlutech and Rovi v Virgin Media. Tom also assisted in AstraZeneca v KRKA, one of the few damages inquiries on a cross-undertaking to go to trial and was subsequently instructed on appeal

Unwired Planet International Ltd v Huawei Technologies Ltd, Samsung Elelectronics Co Ltd and others [2016] EWHC 576 (Pat)

This was the third of the three technical trials. Adrian Speck QC, Mark Chacksfield and Tom Jones (Instructed by EIP Legal) appeared for Unwired Planet in the third of four technical trials (Trial C) concerning the alleged infringment of patents held by Unwired Planet and said to be essential to various mobile telecomminications standards. 

Unwired Planet v Huwaei and Samsung [2015] EWHC 3366 (Pat)

This was the the first of three technical trials concerning alleged infringement of patents held by Unwired Planet said to be essential to various mobile telecommunications standards. Adrian Speck QC, Mark Chacksfield and Tom Jones (instructed by EIP legal) appeared for Unwired Planet.

AstraZeneca AB &Anor v KRKA dd Novo Mesto & Anor [2015] EWCA Civ 484

Tom appeared for the Respondents/Defendants (KRKA) with Andrew Lykiardopoulos QC and was instructed by Innovate Legal.This appeal related to an order for the payment of over £27 million pursuant to cross-undertaking in damages made as a condition of an interim injunction in respect of a generic formulation of the drug esomeprazole.

AGA v Occlutech [2014] EWHC 2506 (Pat)
Assisted in a 6-day patent trial, concerning Nitinol devices for use in curing congenital Atrial Septal Defects in the heart.

Rovi v Virgin Media [2014] EWHC 1559 (Pat)
Assisted in a 6-day patent trial in the series of litigation between Rovi and Virgin Media, concerning set top boxes and the “Red Button” functionality.

Nampak v Alpla [2014] EWHC 2196 (Pat)
Assisted in an application for summary judgment on a declaration of non-infringement of a patent concerning blow moulded plastic milk containers.

Trade Marks & Passing Off 

Specsavers v ASDA [2015] F.S.R. 8
Assisted in a half-day hearing in the Court of Appeal concerning matters consequential to the CJEU ruling on the interpretation of Article 9(1)(b) and (c), 15(1) and 51(1)(a) of the CTMR.

NGRS v Milner [2014] F.S.R. 38
Assisted in a 2-day IPEC trial, concerning infringement and validity of device marks belonging to the National Guild of Removers and Storers, in addition to copyright infringement and passing off.

SIL v Brandconcern
Assisted in an appeal to the Appointed Person concerning the examiner's decision to maintain the partial validity of the trade mark LAMBRETTA for clothes watches and shoes.

Nisa’s Homemade Recipes v Nisa Retail Limited
Assisted in an application to partially invalidate the trade mark NISA for food products, delivery and wholesale services on the basis of prior rights.


Jacobson v Crocs [2014] E.C.C. 16
Assisted in a 2-day application for a stay of infringement and invalidity proceedings pending the outcome of proceeding before OHIM, concerning the design of Crocs shoes.

G-Star v Rhodi [2015] EWHC 216 (Ch)
Assisted in relation to a 3-day trial concerning infringement of design rights in a particular style of G-STAR jeans.

Agent Provocateur v Garner
Assisted in a CMC in proceedings concerning infringement of design right in a particular style of Agent Provocateur bikini, wherein an Ungley ADR order was made.


LOROC Limited v HealthTrak (UK) Limited
Instructed by architects claiming copyright infringement in respect of architectural drawings used to make a planning application. Pending trial in the IPEC.

Absolute Lofts South West London Limited -and- Artisan Home Improvements Limited [2015] EWHC 2608
Instructed in a 1-day IPEC trial concerning copyright in photographs of loft conversions. 

MTP v Pole Star
Assistred in preparation for trial in proceedings concerning copyright in software used in pirate alarm systems on ocean ships, in addition to related patent and design right claims.

Ashley Wilde v TA Textiles
Assisted in a CMC in the IPEC concerning copyright in the decoration of duvet covers.

Damages Inquiries

AstraZeneca v KRKA [2014] EWHC 84 (Pat)
Assisted in a 7-day trial of the damages inquiry on a cross-undertaking given in patent proceedings concerning the proton pump inhibitor drug esomeprazole. Subsequently instructed on appeal [2015] EWCA Civ 484.

Smith & Nephew v ConvaTec  [2014] EWHC 3162 (Pat)
Assisted in an application for summary judgment on a particular head of damages in the pending damages inquiry on a cross-undertaken given by ConvaTec in patent proceedings concerning modified cellulose wound dressings.
