James Abrahams appeared for the defendants in the trial of Destra Software Ltd v Comada (UK) LLP and others [2013] EWHC 1575 (Pat), a copyright infringement action. Following the trial of a preliminary issues, Mr Justice Norris ruled that the defendants owned the copyright in the software that was at the centre of the dispute. Although the written agreement between the parties had not been signed by the claimant, the judge held that the claimant had nevertheless indicated its agreement to the contract by its conduct. He therefore dismissed the claim.
