Martin was invited to give the annual lecture to the Singapore Group of the Asian Patent Attorneys Association (APAA) on recent developments to IP laws in the UK and Europe with comparison to developments in Singapore.
His lecture covered the topics of shape, colour and other unconventional trade marks (Nestle v Cadbury in Europe/UK vs Nestle v Petra in Singapore); Starbucks HK in the Supreme Court and other recent developments in passing off; Interflora v Marks & Spencer and confusion surveys; second medical use patents and infringement issues from ‘off label’ use; the Trunki registered design decision in the Supreme Court; and the possible implications for IP if the UK votes to leave the European Union.
