Martin Howe KC appeared for the claimant, leading Henry Edwards, in a claim for infringement of copyright in the claimant’s synopses, treatment and draft screenplays for a story called “London Dark Web”. She alleged that episodes of the BBC drama “Silent Witness” had been copied from her works.
The BBC and a screenwriter who was also a defendant denied copying, and applied for summary judgment dismissing the claim. Marcus Smith J granted the defendants’ application for summary judgment, holding that the similarities between the works relied upon by the claimant were insufficient to justify a realistically arguable inference that copying must have taken place.
