Saertex France -and-Hexcel Reinforcements UK Limited [2016] EWHC 966 (IPEC)

Henry Ward, instructed by Gowling WLG (UK) LLP, recently appeared for the defendant in this trial concerning European Patent (UK) No. 1 781 455 B1 entitled ‘Method for making a reinforcement provided with at least one adhesive surface capable of being repositioned and resulting reinforcement’ owned by Saertex France. Saertex claimed infringement of the patent. Hexcel Reinforcements UK counterclaimed for invalidity for lack of novelty and inventive step. In response, Saertex made a condition application to amend the patent.

Following a two day trial in the IPEC, HHJ Hacon held the patent invalid both as granted and as conditionally proposed to be amended.
