James Abrahams QC appeared for the appellant in this appeal against an interim injunction and order permitting the claimant to serve the claim form outside the jurisdiction, in relation to a claim for breach of confidence and/or a breach of the Trade Secrets (Enforcement, etc.) Regulations 2018 reg. 3.
In the leading judgment Arnold LJ held that there was a serious issue to be tried notwithstanding that the claimant had not identified the trade secrets which had allegedly been misused. The applicable law was held to be that of the country in which the damage occurred and England was held to be the appropriate forum, the court having regard to the totality of the dispute.
