Members of chambers recently appeared in the first of four technical trials concerning alleged infringement of patents held by Unwired Planet said to be essential to various mobile telecommunications standards. A further trial concerning FRAND and competition issues is scheduled to take place following conclusion of the technical trials.
Adrian Speck QC, Mark Chacksfield and Tom Jones (instructed by EIP legal) appeared for Unwired Planet, who alleged that compliance with the “4G” mobile telecoms standard 3GPP TS 36.322 infringed EP (UK) 2,229,744 entitled “Method and arrangement in a wireless communication network”. Andrew Lykiardopoulos QC (instructed by Powell Gilbert) represented the Huawei Defendants and Charlotte May QC (instructed by Bristows) represented the Samsung Defendants.
Following a two-week trial, Birss J found the patent to be valid and infringed by wireless telecommunication networks that operate in accordance with the relevant 4G standard.
